Eligibility & Account Registration

  • Our services are open to independent musicians, bands, and music-related businesses looking to establish an online presence.
  • When you sign up, you agree to provide accurate, up-to-date information. If your details change, it’s your responsibility to update them.
  • You’re responsible for maintaining the security of your account. If you believe someone has accessed your account without permission, let us know immediately.

Free Artist, Music, and Video Profiles

  • We offer free profiles so indie artists can showcase their music. Each profile includes a hero image, bio, embedded music, and video links.
  • You retain full ownership of your content but grant us permission to display and promote it across our website and social platforms.
  • We reserve the right to modify, remove, or suspend any profile that violates our guidelines, including content that is illegal, hateful, misleading, or infringes on copyright.

Web Design and Hosting Services

  • We provide web design services and host musician websites for consistency, performance, and security.
  • All websites require active hosting and domain renewals to remain online. It’s the artist’s responsibility to maintain a valid payment method on file.
  • If payment lapses, we will issue a notice. If not resolved within a reasonable timeframe, we may suspend or remove the website.

Merch On Demand

  • Our Merch On Demand service allows artists to sell branded merchandise with no upfront costs.
  • Artists earn 80% of profits, and Hamilton Indie Music retains 20% to cover operational costs.
  • We handle everything—from design and production to shipping and customer service.
  • We reserve the right to determine final pricing, product availability, and quality control standards to maintain brand consistency.

Promotion & Marketing

  • By using our services, you grant us permission to promote your profile, music, and merchandise across our website, social media, and other marketing channels.
  • You can request removal from any promotion at any time by contacting us.

Prohibited Conduct

You may not use Hamilton Indie Music to:

  • Post false, misleading, or fraudulent content.
  • Share hateful, harassing, or inappropriate material.
  • Spam or attempt unauthorized reselling of our services.
  • Upload copyrighted material you do not own.

Content Ownership & Copyright

  • You retain full ownership of any content you submit (music, videos, images, and text).
  • You confirm that you have the legal rights to use and distribute all content uploaded to Hamilton Indie Music.
  • We do not claim any ownership over your work, but we require the right to display, promote, and share it across our platform and affiliated channels.

Termination of Services

  • If you no longer wish to use our services, you may request account or profile deletion at any time.
  • We reserve the right to suspend or terminate accounts that violate these terms or engage in any misconduct.

Limitation of Liability

Hamilton Indie Music provides all services “as is” and makes no guarantees regarding website uptime, profile visibility, or sales success. While we make every effort to maintain a reliable platform, we do not guarantee uninterrupted service or that our platform will always function without errors, downtime, or security issues. You acknowledge that technical problems, third-party service interruptions, and unforeseen circumstances may occasionally affect your profile, website, or merchandise sales.

Hamilton Indie Music is not responsible for any loss of revenue, business opportunities, data, or reputational harm that may result from using our services. By using this platform, you accept full responsibility for any risks associated with managing your online presence. If your profile, website, or merch sales experience technical difficulties, delays, or disruptions, we will make reasonable efforts to resolve the issue but are not liable for any resulting damages or financial losses.

Additionally, Hamilton Indie Music relies on third-party service providers for hosting, payment processing, merchandise production, and shipping. While we carefully select partners to ensure high-quality service, we are not responsible for their actions, errors, or any issues that arise from their services. Any disputes related to hosting, payment transactions, product defects, or shipping delays must be addressed directly with the third-party provider in question.

By using our Merch On Demand service, you acknowledge that production and fulfillment times may vary. While we strive for quality and efficiency, occasional printing errors, shipping delays, or product defects may occur. We will work to resolve these issues where possible, but we are not responsible for indirect losses, lost sales, or customer dissatisfaction related to merchandise orders.

Hamilton Indie Music, its owners, employees, and affiliates shall not be held liable for any claims, disputes, or damages arising from your use of the platform, including but not limited to intellectual property claims, content misuse, or order cancellations. In any legal dispute, our maximum liability will not exceed the amount paid by you for any services directly provided by Hamilton Indie Music.

Hamilton Indie Music provides content specific to artists, live music venues and recordings studios. The copyright ownership of all content in relation to each member and user type belongs to the Artist, live music venue and recording studio listed, featured or otherwise included in the site.

Hamilton Indie Music does not claim, suggest or imply copyright ownership of any content specific to Artist, live music venues  or recording studios provided on this site unless otherwise stated.

Third Party Services

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third Party Services”).

If you use any Third Party Services, you understand that:

  • Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services.
  • You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such web sites or services.

Accounts

Where use of any part of our Services requires an account, you agree to provide us with complete and accurate information when you register for an account.

You will be solely responsible and liable for any activity that occurs under your account. You are responsible for keeping your account information up-to-date and for keeping your password secure.

Disclaimer

Our Services are provided “AS IS.” and “AS AVAILABLE” basis. Hamilton Indie Music and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Hamilton Indie Music, nor its suppliers and licensors, makes any warranty that our Services will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of Canada.

The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the province and federal courts located in Canada.

Changes

Hamilton Indie Music reserves the right, at our sole discretion, to modify or replace these Terms at any time.

If we make changes that are material, we will let you know by posting on our website, by sending you an email or other communication when the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.
